Ratifica a Convenção sobre a Eliminação de Todas as Formas de Discriminação contra as Mulheres

A Assembleia da República decreta, nos termos da alínea j) do artigo 164.º e do n.º 2 do artigo 169.º da Constituição, o seguinte:

É aprovada a Convenção sobre a Eliminação de Todas as Formas de Discriminação contra as Mulheres, cujo texto em inglês e respectiva tradução para português vão anexos ao presente diploma.

ANNEX

Convention on the Elimination of All Forms of Discrimination against Women

The States Parties to the present Convention,

Noting that the Charter of the United Nations reaffirms faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women;

Noting that the Universal Declaration of Human Rights affirms the principle of the inadmissibility of discrimination and proclaims that all human beings are born free and equal in dignity and rights and that everyone is entitled to all the rights and freedoms set forth therein, without distinction of any kind, including distinction based on sex;

Noting that the States Parties to the International Covenants on Human Rights have the obligation to ensure the equal right of men and women to enjoy all economic, social, cultural, civil and political rights;

Considering the international conventions concluded under the auspices of the United Nations and the specialized agencies promoting equality of rights of men and women;

Noting also the resolutions, declarations and recommendations adopted by the United Nations and the specialized agencies promoting equality of rights of men and women;

Concerned, however, that, despite these various instruments, extensive discrimination against women continues to exist;

Recalling that discrimination against women violates the principles of equality of rights and respect for human dignity, is an obstacle to the participation of women, on equal terms with men, in the political, social, economic and cultural life of their countries, hampers the growth of the prosperity of society and the family and makes more difficult the full development of the potentialities of women in the service of their countries and of humanity;

Concerned that in situations of poverty women have the least access to food, health, education, training and opportunities for employment and other needs;

Convinced that the establishment of the new international economic order based on equity and justice will contribute significantly towards the promotion of equality between men and women;

Emphasizing that the eradication of apartheid, of all forms of racism, racial discrimination, colonialism, neocolonialism, aggression, foreign occupation and domination and interference in the internal affairs of States is essential to the full enjoyment of the rights of men and women;

Affirming that the strengthening of international peace and security, relaxation of international tension, mutual cooperation among all States, irrespective of their social and economic systems, general and complete disarmament, in particular nuclear disarmament under strict and effective international control, the affirmation of the principles of justice, equality and mutual benefit in relations among countries and the realization of the right of peoples under alien and colonial domination and foreign occupation to self-determination and independence, as well as respect for national sovereignty and territorial integrity, will promote social progress and development and as a consequence will contribute to the attainment of full equality between men and women;

Convinced that the full and complete development of a country, the welfare of the world and the cause of peace require the maximum participation of women on equal terms with men in all fields;

Bearing in mind the great contribution of women to the welfare of the family and to the development of society, so far not fully recognized, the social significance of maternity and the role of both parents in the family and in the upbringing of children, and aware that the role of women in procreation should not be a basis for discrimination, but that the upbringing of chindren requires a sharing of responsibility between men and women and society as a whole;

Aware that a change in the traditional role of men as well as the role of women in society and in the family is needed to achieve full equality between men and women;

Determined to implement the principles set forth in the Declaration on the Elimination of Discrimination against Women and, for that purpose, to adopt the measures required for the elimination of such discrimination in all its forms and manifestations:

Have agreed on the following:

PART I

ARTICLE I

For the purpose of the present Convention, the term 'discrimination against women' shall mean any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on abasis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil ou any other field.

ARTICLE 2

States Parties condemn discrimination against women in all its forms, agree to pursue by all appropriate means and without delay a policy of eliminating discrimination against women and, to this end, undertake:

a) To embody the principle of the equality of men and women in their national constitutions or other appropriate legislation if not yet incorporated therein and to ensure, through law and other appropriate means, the practical realization of this principle;

b) To adopt appropriate legislative and other measures, including sanction where appropriate, prohibiting all discrimination against women;

c) To establish legal protection of the rights of women on an equal basis with men and to ensure through competent national tribunals and other public institutions the effective protection of women against any act of discrimination;

d) To refrain from engaging in any act or practice of discrimination against women and to ensure that public authorities and institutions shall act in conformity with this obligation;

e) To take all appropriate measures to eliminate discrimination against women by any person, organization or enterprise;

f) To take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices which constitute discrimination against women;

g) To repeal all national penal provisions which constitute discrimination against women.

ARTICLE 3

States Parties shall take in all fields, in particular in the political, social, economic and cultural fields, all appropriate measures, including legislation, to ensure the full development and advancement of women, for the purpose of guaranteeing them the exercise and enjoyment of human rights and fundamental freedoms on a basis of equality with men.

ARTICLE 4

1 Adoption by States Parties of temporary special measures aimed at accelerating de facto equality between men and women shall not be considered discrimination as defined in the present Convention, but shall in no way entail as a consequence the maintenance of unequal or separate standards; these measures shall be discontinued when the objectives of equality of opportunity and treatment have been achieved.

2. Adoption by States Parties of special measures, including those measures contained in the present Convention, aimed at protecting maternity shall not be considered discriminatory.

ARTICLE 5

States Parties shall take all appropriate measures:

a) To modify the social and cultural patterns of conduct of men and women, with a view to achieving the elimination of prejudices and customary and all other practices which are based on the idea of the inferiority or the superiority of either of the sexes or on stereotyped roles for men and women;

b) To ensure that family education includes a proper understanding of maternity as a social function and the recognition of the common responsibility of men and women in the upbringing and development of their children, it being understood that the interest of the children is the primordial consideration in all cases.

ARTICLE 6

States Parties shall take all appropriate measures, including legislation, to suppress all forms of traffic in women and exploitation of prostitution of women.

PART II

ARTICLE 7

States Parties shall take all appropriate measures to eliminate discrimination against women in the political and public life of the country and, in particular, shall ensure to women, on equal terms with men, the right:

a) To vote in all elections and public referenda and to be eligible for election to all publicly elected bodies;

b) To participate in the formulation of government policy and the implementation thereof and to hold public office and perform all public functions at all levels of government;

c) To participate in neo-governmental organizations and associations concerned with the public and political life of the country.

ARTICLE 8

States Parties shall take all appropriate measures to ensure to women, on equal terms with men and without any discrimination, the opportunity to represent their Governments at the international level and to participate in the work of international organizations.

ARTICLE 9

1 - States Parties shall great women equal rights with men to acquire, change or retain their nationality. They shall ensure, in particular, that neither marriage to an alien nor change of nationality by the husband during marriage shall automatically change the nationality of the wife, render her stateless or force upon her the nationality of the husband.

2 - States Parties shall grant women equal rights with men with respect to the nationality of their children.

PART III

ARTICLE 10

States Parties shall take all appropriate measures to eliminate discrimination against women in order to ensure to them equal rights with men in the field of education and, in particular, to ensure, on a basis of equality of men and women:

a) The same conditions for career and vocational guidance, for access to studies and for the achievement of diplomas in educational establishments of all categories, in rural as well as in urban areas; this equality shall be ensured in pre-school, general, technical, professional and higher technical education, as well as in all types of vocational training;

b) Access to the same curricula, the same examinations, teaching staff with qualifications of the same standard and school premises and equipment of the same quality;

c) The elimination of any stereotyped concept of the roles of men and women at all levels and in all forms of education by encouraging coeducation and other types of education which will help to achieve this aim, in particular by the revision of textbooks and school programmes and the adaptation of teaching methods;

d) The same opportunities to benefit from scholarships and other study grants;

e) The same opportunities for access to programmes of continuing education, including adult and functional literacy programmes, particularly those aimed at reducing, at the earliest possible time, any gap in education existing between men and women;

f) The reduction of female student drop-out rates and the organization of programmes for girls and women who have left school prematurely;

g) The same opportunities to participate actively in sports and physical education;

h) Access to specific educational information to help to ensure the health and well-being of families, including information and advice on family planning.

ARTICLE 11

1 - States Parties shall take all appropriate measures to eliminate discrimination against women in the field of employment in order to ensure, on a basis of equality of men and women, the same rights, in particular:

a) The right to work as an inalienable right of all human beings;

b) The right to the same employment opportunities, including the application of the same criteria for selection in matters of employment;

c) The right to free choice of profession and employment, the right to promotion, job security and all benefits and conditions of service and the right to receive vocational training and retraining including apprenticeships, advanced vocational training and recurrent training;

d) The right to equal remuneration, including benefits, and to equal treatment in respect of work of equal value, as well as equality of treatment in the evaluation of the quality of work;

e) The right to social security, particularly in cases of retirement, unemployment, sickness, invalidity and old age and other incapacity to work, as well as the right to paid leave;

f) The right to protection of health and to safety in working conditions, including the safeguarding of the function of reproduction.

2 - In order to prevent discrimination against women on the grounds of marriage or maternity and to ensure their effective right to work, States Parties shall take appropriate measures:

a) To prohibit, subject to the imposition of sanctions, dismissal on the grounds of pregnancy or of maternity leave and discrimination in dismissals on the basis of marital status;

b) To introduce maternity leave with pay or with comparable social benefits without loss of former employment, seniority or social allowances;

c) To encourage the provision of the necessary supporting social services to enable parents to combine family obligation with work responsibilities and participation in public life, in particular through promoting the establishment and development of a network of child-care facilities;

d) To provide special protection to women during pregnancy in types of work proved to be harmful to them.

3 - Protective legislation relating to matters covered in this article shall be reviewed periodically in the light of scientific and technological knowledge and shall be revised, repealed or extended as necessary.

ARTICLE 12

1 - States Parties shall take all appropriate measures to eliminate discrimination against women in the field of health care in order to ensure, on a basis of equality of men and women, access to health care services, including those related to family planning.

2 - Notwithstanding the provisions of paragraph 1 of this article, States Parties shall ensure to women appropriate services in connexion with pregnancy, confinement and the post-natal period, granting free services where necessary, as well as adequate nutrition during pregnancy and lactation.

ARTICLE 13

States Parties shall take all appropriate measures to eliminate discrimination against women in other areas of economic and social life, in order to ensure, on a basis of equality of men and women, the same rights, in particular:

a) The right to family benefits;

b) The right to bank loans, mortgages and other forms of financial credit;

c) The right to participate in recreational activities, sports and all aspects of cultural life.

ARTICLE 14

1 - States Parties shall take into account the particular problems faced by rural women and the significant roles which rural women play in the economic survival of their families, including their work in the non-monetized sectors of the economy, and shall take all appropriate measures to ensure the application of the provisions of this Convention to women in rural areas.

2 - States Parties shall take all appropriate measures to eliminate discrimination against women in rural areas, in order to ensure, on a basis of equality of men and women, that they participate in and benefit from rural development and, in particular, shall ensure to such women the right:

a) To participate in the elaboration and implementation of development planning at all levels;

b) To have access to adequate health care facilities, including information, counselling and services in family planning;

c) To benefit directly from social security programmes;

d) To obtain all types of training and education, formal and non-formal, including that relating to functional literacy, as well as, inter alia, the benefit of all community and extension services, in order to increase their technical proficiency;

e) To organize self-help groups and co-operatives in order to obtain equal access to economic opportunities through employment or self-employment;

f) To participate in all community activities;

g) To have access to agricultural credit and loans, marketing facilities, appropriate technology and equal treatment in land and agrarian reform, as well as in land resettlement schemes;

h) To enjoy adequate living conditions, particularly in relation to housing, sanitation, electricity and water supply, transport and communications.

PART IV

ARTICLE 15

1 - States Parties shall accord to women equality with men before the law.

2 - States Parties shall accord to women, in civil matters, a legal capacity identical to that of men and the same opportunities to exercise that capacity. In particular, they shall give women equal rights to conclude contracts and to administer property and shall treat them equally in all stages of procedure in courts and tribunals.

3 - States Parties agree that all contracts and all other private instruments of any kind with a legal effect which is directed at restricting the legal capacity of women shall be deemed null and void.

4 - States Parties shall accord to men and women the same rights with regard to the law relating to the movement of persons and the freedom to choose their residence and domicile.

ARTICLE 16

1 - States Parties shall take all appropriate measures to eliminate discrimination against women in all matters relating to marriage and family relations and, in particular, shall ensure, on a basis of equality of men and women:

a) The same right to enter into marriage;

b) The same right freely to choose a spouse and to enter into marriage only with their free and full consent;

c) The same rights and responsibilities during marriage and at its dissolution;

d) The same rights and responsibilities as parents irrespective of their marital status, in matters relating to their children; in all cases, the interests of the children shall be paramount;

e) The same rights to decide freely and responsibly on the number and spacing of their children and to have access to the information, education and means to enable them to exercise these rights;

f) The same rights and responsibilities with regard to guardianship, wardship, trusteeship and adoption of children, or similar institutions, where these concepts exist in national legislation; in all cases, the interests of the children shall be paramount;

g) The same personal rights as husband and wife, including the right to choose a family name, a profession and an occupation;

h) The same rights for both spouses in respect of the ownership, acquisition, management, administration, enjoyment and disposition of property, whether free of charge or for a valuable consideration.

2 - The betrothal and the marriage of a child shall have no legal effect, and all necessary action, including legislation, shall be taken to specify a minimum age for marriage and to make the registration of marriages in an official registry compulsory.

PART V

ARTICLE 17

1 - For the purpose of considering the progress made in the implementation of the present Convention, there shall be established a Committee on the Elimination of Discrimination against Women (hereinafter referred to as the Committee), consisting, at the time of entry into force of the Convention, of eighteen and, after ratification of or accession to the Convention by the thirty-fifth State Party, of twenty-three experts of high moral standing and competence in the field covered by the Convention. The experts shall be elected by States Parties from among their nationals and shall serve in their personal capacity, consideration being given to equitable geographical distribution and to the representation of the different forms of civilization, as well as the principal legal systems.

2 - The members of the Committee shall be elected by secret ballot from a list of persons nominated by States Parties. Each State Party may nominate one person from among its own nationals.

3 - The initial election shall be held six months after the date of the entry into force of the present Convention. At least three months before the date of each election the Secretary-General of the United Nations shall address a letter to the States Parties inviting them to submit their nominations within two months. The Secretary-General shall prepare a list in alphabetical order of all persons thus nominated, indicating the States Parties which have nominated them, and shall submit it to the States Parties.

4 - Elections of the members of the Committee shall be held at a meeting of States Parties convened by the Secretary-General at United Nations headquarters. At that meeting, for which two thirds of the States Parties shall constitute a quorum, the persons elected to the Committee shall be those nominees who obtain the largest number of votes and an absolute majority of the votes of the representatives of States Parties present and voting.

5 - The members of the Committee shall be elected for a term of four years. However, the terms of nine of the members elected at the first election shall expire at the end of two years; immediately after the first election the names of these nine members shall be chosen by lot by the chairman of the Committee.

6 - The election of the five additional members of the Committee shall be held in accordance with the provisions of paragraphs 2, 3 and 4 of this article, following the 35th ratification or accession. The terms of two of the additional members elected on this occasion shall expire at the end of two years, the names of these two members having been chosen by lot by the chairman of the Committee.

7 - For the filling of casual vacancies, the State Party whose expert has ceased to function as a member of the Committee shall appoint another expert from among its nationals, subject to the approval of the Committee.

8 - The members of the Committee shall, with the approval of the General Assembly, receive emoluments from United Nations resources on such terms and conditions as the Assembly may decide, having regard to the importance of the Committee's responsibilities.

9 - The Secretary-General of the United Nations shall provide the necessary staff and facilities for the effective performance of the functions of the Committee under the present Convention.

ARTICLE 18

1 - States Parties undertake to submit to the Secretary-General of the United Nations, for consideration by the Committee, a report on the legislative, judicial, administrative or other measures which they have adopted to give effect to the provisions of the present Convention and on the progress made in this respect:

a) Within one year after the entry into force for the State concerned;

b) Thereafter at least every four years and further whenever the Committee so requests.

2 - Reports may indicate factors and difficulties affecting the degree of fulfilment of obligations under the present Convention.

ARTICLE 19

1 - The Committee shall adopt its own rules of procedure.

2 - The Committee shall elect its officers for a term of two years.

ARTICLE 20

1 - The Committee shall normally meet for a period of not more than two weeks annually in order to consider the reports submitted in accordance with article 18 of the present Convention.

2 - The meetings of the Committee shall normally be held at United Nations headquarters or at any other convenient place as determined by the Committee.

ARTICLE 21

1 - The Committee shall, through the Economic and Social Council, report annually to the General Assembly of the United Nations on its activities and may make suggestions and general recommendations based on the examination of reports and information received from the States Parties. Such suggestions and general recommendations shall be included in the report of the Committee together with comments, if any, from States Parties.

2 - The Secretary-General shall transmit the reports of the Committee to the Commission on the Status of Women for its information.

ARTICLE 22

The specialized agencies shall be entitled to be represented at the consideration of the implementation of such provisions of the present Convention as fall within the scope of their activities. The Committee may invite the specialized agencies to submit reports on the implementation of the Convention in areas falling within the scope of their activities.

PART VI

ARTICLE 23

Nothing in this Convention shall affect any provisions that are more conducive to the achievement of equality between men and women which may be contained:

a) In the legislation of a State Party;

b) In any other international convention, treaty or agreement in force for that State.

ARTICLE 24

States Parties undertake to adopt all necessary measures at the national level aimed at achieving the full realization of the rights recognized in the present Convention.

ARTICLE 25

1 - The present Convention shall be open for signature by all States.

2 - The Secretary-General of the United Nations is designated as the depositary of the present Convention.

3 - The present Convention is subject to ratification. Instruments of ratification shall be deposited with the Secretary-General of the United Nations.

4 - The present Convention shall be open to accession by all States. Accession shall be effected by the deposit of an instrument of accession with the Secretary-General of the United Nations.

ARTICLE 26

1 - A request for the revision of the present Convention may be made at any time by any State Party by means of a notification, in writing addressed to the Secretary-General of the United Nations.

2 - The General Assembly of the United Nations shall decide upon the steps, if any, to be taken in respect of such a request.

ARTICLE 27

1 - The present Convention shall enter into force on the 30th day after the date of deposit with the Secretary-General of the United Nations of the 20th instrument of ratification or accession.

2 - For each State ratifying the present Convention or acceding to it after the deposit of the 20th instrument of ratification or accession, the Convention shall enter into force on the 30th day after the date of the deposit of its own instrument of ratification or accession.

ARTICLE 28

1 - The Secretary-General of the United Nations shall receive and circulate to all States the next of reservations made by States at the time of ratification or accession.

2 - A reservation incompatible with the object and purpose of the present Convention shall not be permitted.

3 - Reservations may be withdrawn at any time by notification to this effect addressed to the Secretary-General of the United Nations, who shall then inform all States thereof. Such notification shall take effect on the date on which it is received.

ARTICLE 29

1 - Any dispute between two or more States Parties concerning the interpretation or application of the present Convention which is not settled by negotiation shall, at the request of one of them, be submitted to arbitration. If within six months from the date of the request for arbitration the Parties are unable to agree on the organization of the arbitration, any one of those Parties may refer the dispute to the International Court of Justice, by request in conformity with the Statute of the Court.

2 - Each State Party may, at the time of signature or ratification of this Convention or accession thereto, declare that it does not consider itself bound by paragraph 1 of this article. The other States Parties shall not be bound by that paragraph with respect to any State Party which has made such a reservation.

3 - Any State Party which has made a reservation in accordance with paragraph 2 of this article may at any time withdraw that reservation by notification to the Secretary-General of the United Nations.

ARTICLE 30

The present Convention, the Arabic, Chinese, English, French, Russian and Spanish texts of which are equally authentic, shall be deposited with the Secretary-General of the United Nations.

ANEXO

Convenção sobre a Eliminação de Todas as Formas de Discriminação contra as Mulheres

Os Estados Partes na presente Convenção,

Considerando que a Carta das Nações Unidas reafirma a fé nos direitos fundamentais do homem, na dignidade e no valor da pessoa humana e na igualdade de direitos dos homens e das mulheres;

Considerando que a Declaração Universal dos Direitos do Homem afirma o princípio da não discriminação e proclama que todos os seres humanos nascem livres e iguais em dignidade e em direitos e que cada pessoa pode prevalecer-se de todos os direitos e de todas as liberdades aí enunciados, sem distinção alguma, nomeadamente de sexo;

Considerando que os Estados Partes nos pactos internacionais sobre direitos do homem têm a obrigação de assegurar a igualdade de direitos dos homens e das mulheres no exercício de todos os direitos económicos, sociais, culturais, civis e políticos;

Considerando as convenções internacionais concluídas sob a égide da Organização das Nações Unidas e das instituições especializadas com vista a promover a igualdade de direitos dos homens e das mulheres;

Considerando igualmente as resoluções, declarações e recomendações adoptadas pela Organização das Nações Unidas e pelas instituições especializadas com vista a promover a igualdade de direitos dos homens e das mulheres;

Preocupados, no entanto, por constatarem que, apesar destes diversos instrumentos, as mulheres continuam a ser objecto de importantes discriminações;

Lembrando que a discriminação contra as mulheres viola os princípios da igualdade de direitos e do respeito da dignidade humana, que dificulta a participação das mulheres, nas mesmas condições que os homens, na vida política, social, económica e cultural do seu país, que cria obstáculos ao crescimento do bem-estar da sociedade e da família e que impede as mulheres de servirem o seu país e a Humanidade em toda a medida das suas possibilidades;

Preocupados pelo facto de que em situações de pobreza as mulheres têm um acesso mínimo à alimentação, aos serviços médicos, à educação, à formação e às possibilidades de emprego e à satisfação de outras necessidades;

Convencidos de que a instauração da nova ordem económica internacional baseada na equidade e na justiça contribuirá de forma significativa para promover a igualdade entre os homens e as mulheres;

Sublinhando que a eliminação do apartheid, de todas as formas de racismo, de discriminação racial, de colonialismo, de neocolonialismo, de agressão, de ocupação e dominação estrangeiras e de ingerência nos assuntos internos dos Estados é indispensável ao pleno gozo dos seus direitos pelos homens e pelas mulheres;

Afirmando que o reforço da paz e da segurança internacionais, o abrandamento da tensão internacional, a cooperação entre todos os Estados, sejam quais forem os seus sistemas sociais e económicos, o desarmamento geral e completo, em particular o desarmamento nuclear sob contrôle internacional estrito e eficaz, a afirmação dos princípios da justiça, da igualdade e da vantagem mútua nas relações entre países e a realização do direito dos povos sujeitos a dominação estrangeira e colonial e a ocupação estrangeira à autodeterminação e à independência, assim como o respeito da soberania nacional e da integridade territorial, favorecerão o progresso social e o desenvolvimento e contribuirão en consequência para a realização da plena igualdade entre os homens e as mulheres;

Convencidos de que o desenvolvimento pleno de um país, o bem-estar do mundo e a causa da paz necessitam da máxima participação das mulheres, em igualdade com os homens, em todos os domínios;

Tomando em consideração a importância da contribuição das mulheres para o bem-estar da família e o progresso da sociedade, que até agora não foi plenamente reconhecida, a importância social da maternidade e do papel de ambos os pais na família e na educação das crianças, e conscientes de que o papel das mulheres na procriação não deve ser uma causa de discriminação, mas de que a educação das crianças exige a partilha das responsabilidades entre os homens, as mulheres e a sociedade no seu conjunto;

Conscientes de que é necessária uma mudança no papel tradicional dos homens, tal como no papel das mulheres na família e na sociedade, se se quer alcançar uma real igualdade dos homens e das mulheres;

Resolvidos a pôr em prática os princípios enunciados na Declaração sobre a Eliminação da Discriminação contra as Mulheres e, com tal objectivo, a adoptar as medidas necessárias à supressão desta discriminação sob todas as suas formas e em todas as suas manifestações:

Acordam no seguinte:

PARTE I

Artigo 1.º

Para os fins da presente Convenção, a expressão 'discriminação contra as mulheres' significa qualquer distinção, exclusão ou restrição baseada no sexo que tenha como efeito ou como objectivo comprometer ou destruir o reconhecimento, o gozo ou o exercício pelas mulheres, seja qual for o seu estado civil, com base na igualdade dos homens e das mulheres, dos direitos do homem e das liberdades fundamentais nos domínios político, económico, social, cultural e civil ou em qualquer outro domínio.

Artigo 2.º

Os Estados Partes condenam a discriminação contra as mulheres sob todas as suas formas, acordam em prosseguir, por todos os meios apropriados e sem demora, uma política tendente a eliminar a discriminação contra as mulheres e, com este fim, comprometem-se a:

a) Inscrever na sua constituição nacional ou em qualquer outra lei apropriada o princípio da igualdade dos homens e das mulheres, se o mesmo não tiver já sido feito, e assegurar por via legislativa ou por outros meios apropriados a aplicação efectiva do mesmo princípio;

b) Adoptar medidas legislativas e outras medidas apropriadas, incluindo a determinação de sanções em caso de necessidade, proibindo toda a discriminação contra as mulheres;

c) Instaurar uma protecção jurisdicional dos direitos das mulheres em pé de igualdade com os homens e garantir, por intermédio dos tribunais nacionais competentes e outras instituições públicas, a protecção efectiva das mulheres contra qualquer acto discriminatório;

d) Abster-se de qualquer acto ou prática discriminatórios contra as mulheres e actuar por forma que as autoridades e instituições públicas se conformem com esta obrigação;

e) Tomar todas as medidas apropriadas para eliminar a discriminação praticada contra as mulheres por uma pessoa, uma organização ou uma empresa qualquer;

f) Tomar todas as medidas apropriadas, incluindo disposições legislativas, para modificar ou revogar qualquer lei, disposição regulamentar, costume ou prática que constitua discriminação contra as mulheres;

g) Revogar todas as disposições penais que constituam discriminação contra as mulheres.

Artigo 3.º

Os Estados Partes tomam em todos os domínios, nomeadamente nos domínios político, social, económico e cultural, todas as medidas apropriadas, incluindo disposições legislativas, para assegurar o pleno desenvolvimento e o progresso das mulheres, com vista a garantir-lhes o exercício e o gozo dos direitos do homem e das liberdades fundamentais, com base na igualdade com os homens.

Artigo 4.º

1 - A adopção pelos Estados Partes de medidas temporárias especiais visando acelerar a instauração de uma igualdade de facto entre os homens e as mulheres não é considerada como um acto de discriminação, tal como definido na presente Convenção, mas não deve por nenhuma forma ter como consequência a manutenção de normas desiguais ou distintas; estas medidas devem ser postas de parte quando os objectivos em matéria de igualdade de oportunidades e de tratamento tiverem sido atingidos.

2 - A adopção pelos Estados Partes de medidas especiais, incluindo as medidas previstas na presente Convenção que visem proteger a maternidade, não é considerada como um acto discriminatório.

Artigo 5.º

Os Estados Partes tomam todas as medidas apropriadas para:

a) Modificar os esquemas e modelos de comportamento sócio-cultural dos homens e das mulheres com vista a alcançar a eliminação dos preconceitos e das práticas costumeiras, ou de qualquer outro tipo, que se fundem na ideia de inferioridade ou de superioridade de um ou de outro sexo ou de um papel estereotipado dos homens e das mulheres;

b) Assegurar que a educação familiar contribua para um entendimento correcto da maternidade como função social e para o reconhecimento da responsabilidade comum dos homens e das mulheres na educação e desenvolvimento dos filhos, devendo entender-se que o interesse das crianças é consideração primordial em todos os casos.

Artigo 6.º

Os Estados Partes tomam todas as medidas apropriadas, incluindo disposições legislativas, para suprimir todas as formas de tráfico das mulheres e de exploração da prostituição das mulheres.

PARTE II

Artigo 7.º

Os Estados Partes tomam todas as medidas apropriadas para eliminar a discriminação contra as mulheres na vida política e pública do país e, em particular, asseguram-lhes, em condições de igualdade com os homens, o direito:

a) De votar em todas as eleições e em todos os referendos públicos e de ser elegíveis para todos os organismos publicamente eleitos;

b) De tomar parte na formulação da política do Estado e na sua execução, de ocupar empregos públicos e de exercer todos os cargos públicos a todos os níveis do governo;

c) De participar nas organizações e associações não governamentais que se ocupem da vida pública e política do país.

Artigo 8.º

Os Estados Partes tomam todas as medidas apropriadas para que as mulheres, em condições de igualdade com os homens e sem nenhuma discriminação, tenham a possibilidade de representar os seus governos à escala internacional e de participar nos trabalhos das organizações internacionais.

Artigo 9.º

1 - Os Estados Partes concedem às mulheres direitos iguais aos dos homens no que respeita à aquisição, mudança e conservação da nacionalidade. Garantem, em particular, que nem o casamento com um estrangeiro nem a mudança de nacionalidade do marido na constância do casamento produzem automaticamente a mudança de nacionalidade da mulher, a tornam apátrida ou a obrigam a adquirir a nacionalidade do marido.

2 - Os Estados Partes concedem às mulheres direitos iguais aos dos homens no que respeita à nacionalidade dos filhos.

PARTE III

Artigo 10.º

Os Estados Partes tomam todas as medidas apropriadas para eliminar a discriminação contra as mulheres com o fim de lhes assegurar direitos iguais aos dos homens no domínio da educação e, em particular, para assegurar, com base na igualdade dos homens e das mulheres:

a) As mesmas condições de orientação profissional, de acesso aos estudos e de obtenção de diplomas nos estabelecimentos de ensino de todas as categorias, nas zonas rurais como nas zonas urbanas, devendo esta igualdade ser assegurada no ensino pré-escolar, geral, técnico, profissional e técnico superior, assim como em qualquer outro meio de formação profissional;

b) O acesso aos mesmos programas, aos mesmos exames, a um pessoal de ensino possuindo qualificações do mesmo nível, a locais escolares e a equipamento da mesma qualidade;

c) A eliminação de qualquer concepção estereotipada dos papéis dos homens e das mulheres a todos os níveis e em todas as formas de ensino, encorajando a coeducação e outros tipos de educação que ajudarão a realizar este objectivo, em particular revendo os livros e programas escolares e adaptando os métodos pedagógicos;

d) As mesmas possibilidades no que respeita à concessão de bolsas e outros subsídios para os estudos;

e) As mesmas possibilidades de acesso aos programas de educação permanente, incluindo os programas de alfabetização para adultos e de alfabetização funcional, com vista, nomeadamente, a reduzir o mais cedo possível qualquer desnível de instrução que exista entre os homens e as mulheres;

f) A redução das taxas de abandono feminino dos estudos e a organização de programas para as raparigas e as mulheres que abandonarem prematuramente a escola;

g) As mesmas possibilidades de participar activamente nos desportos e na educação física;

h) O acesso a informações específicas de carácter educativo tendentes a assegurar a saúde e o bem-estar das famílias, incluindo a informação e o aconselhamento relativos ao planeamento da família.

Artigo 11.º

1 - Os Estados Partes comprometem-se a tomar todas as medidas apropriadas para eliminar a discriminação contra as mulheres no domínio do emprego com o fim de assegurar, com base na igualdade dos homens e das mulheres, os mesmos direitos, em particular:

a) O direito ao trabalho, enquanto direito inalienável de todos os seres humanos;

b) O direito às mesmas possibilidades de emprego, incluindo a aplicação dos mesmos critérios de selecção em matéria de emprego;

c) O direito à livre escolha da profissão e do emprego, o direito à promoção, à estabilidade do emprego e a todas as prestações e condições de trabalho e o direito à formação profissional e à reciclagem, incluindo a aprendizagem, o aperfeiçoamento profissional e a formação permanente;

d) O direito à igualdade de remuneração, incluindo prestações, e à igualdade de tratamento para um trabalho de igual valor, assim como à igualdade de tratamento no que respeita à avaliação da qualidade do trabalho;

e) O direito à segurança social, nomeadamente às prestações de reforma, desemprego, doença, invalidez e velhice ou relativas a qualquer outra perda de capacidade de trabalho, assim como o direito a férias pagas;

f) O direito à protecção da saúde e à segurança nas condições de trabalho, incluindo a salvaguarda da função de reprodução.

2 - Com o fim de evitar a discriminação contra as mulheres por causa do casamento ou da maternidade e de garantir o seu direito efectivo ao trabalho, os Estados Partes comprometem-se a tomar medidas apropriadas para:

a) Proibir, sob pena de sanções, o despedimento por causa da gravidez ou de gozo do direito a um período de dispensa do trabalho por ocasião da maternidade, bem como a discriminação nos despedimentos fundada no estado matrimonial;

b) Instituir a concessão do direito a um período de dispensa do trabalho por ocasião da maternidade pago ou conferindo direito a prestações sociais comparáveis, com a garantia da manutenção do emprego anterior, dos direitos de antiguidade e das vantagens sociais;

c) Encorajar o fornecimento dos serviços sociais de apoio necessários para permitir aos pais conciliar as obrigações familiares com as responsabilidades profissionais e a participação na vida pública, em particular favorecendo a criação e o desenvolvimento de uma rede de estabelecimentos de guarda de crianças;

d) Assegurar uma protecção especial às mulheres grávidas cujo trabalho é comprovadamente nocivo.

3 - A legislação que visa proteger as mulheres nos domínios abrangidos pelo presente artigo será revista periodicamente em função dos conhecimentos científicos e técnicos e será modificada, revogada ou alargada segundo as necessidades.

Artigo 12.º

1 - Os Estados Partes tomam todas as medidas apropriadas para eliminar a discriminação contra as mulheres no domínio dos cuidados de saúde, com vista a assegurar-lhes, com base na igualdade dos homens e das mulheres, o acesso aos serviços médicos, incluindo os relativos ao planeamento da família.

2 - Não obstante as disposições do parágrafo 1 deste artigo, os Estados Partes fornecerão às mulheres durante a gravidez, durante o parto e depois do parto serviços apropriados e, se necessário, gratuitos, assim como uma nutrição adequada durante a gravidez e o aleitamento.

Artigo 13.º

Os Estados Partes comprometem-se a tomar todas as medidas apropriadas para eliminar a discriminação contra as mulheres em outros domínios da vida económica e social, com o fim de assegurar, com base na igualdade dos homens e das mulheres, os mesmos direitos, em particular:

a) O direito a prestações familiares;

b) O direito a empréstimos bancários, empréstimos hipotecários e outras formas de crédito financeiro;

c) O direito de participar nas actividades recreativas, nos desportos e em todos os aspectos da vida cultural.

Artigo 14.º

1 - Os Estados Partes têm em conta os problemas particulares das mulheres rurais e o papel importante que estas mulheres desempenham para a sobrevivência económica das suas famílias, nomeadamente pelo seu trabalho nos sectores não monetários da economia, e tomam todas as medidas apropriadas para assegurar a aplicação das disposições da presente Convenção às mulheres das zonas rurais.

2 - Os Estados Partes tomam todas as medidas apropriadas para eliminar a discriminação contra as mulheres nas zonas rurais, com o fim de assegurar, com base na igualdade dos homens e das mulheres, a sua participação no desenvolvimento rural e nas suas vantagens e, em particular, assegurando-lhes o direito:

a) De participar plenamente na elaboração e na execução dos planos do desenvolvimento a todos os níveis;

b) De ter acesso aos serviços adequados no domínio da saúde, incluindo a informação, aconselhamento e serviços em matéria de planeamento da família;

c) De beneficiar directamente dos programas de segurança social;

d) De receber qualquer tipo de formação e de educação, escolares ou não, incluindo em matéria de alfabetização funcional, e de poder beneficiar de todos os serviços comunitários e de extensão, nomeadamente para melhorar a sua competência técnica;

e) De organizar grupos de entreajuda e cooperativas com o fim de permitir a igualdade de oportunidades no plano económico, quer se trate de trabalho assalariado ou de trabalho independente;

f) De participar em todas as actividades da comunidade;

g) De ter acesso ao crédito e aos empréstimos agrícolas, assim como aos serviços de comercialização e às tecnologias apropriadas, e de receber um tratamento igual nas reformas fundiárias e agrárias e nos projectos de reordenamento rural;

h) De beneficiar de condições de vida convenientes, nomeadamente no que diz respeito a alojamento, saneamento, fornecimento de electricidade e de água, transportes e comunicações.

PARTE IV

Artigo 15.º

1 - Os Estados Partes reconhecem às mulheres a igualdade com os homens perante a lei.

2 - Os Estados Partes reconhecem às mulheres em matéria civil, capacidade jurídica idêntica à dos homens e as mesmas possibilidades de exercício dessa capacidade. Reconhecem-lhes, em particular direitos iguais no que respeita à celebração de contrato e à administração dos bens e concedem-lhes o mesmo tratamento em todos os estádios do processo judicial.

3 - Os Estados Partes acordam em que qualquer contrato e qualquer outro instrumento privado, seja de que tipo for, que vise limitar a capacidade jurídica da mulher deve ser considerado como nulo.

4 - Os Estados Partes reconhecem aos homens e às mulheres os mesmos direitos no que respeita à legislação relativa à livre circulação das pessoas e a liberdade de escolha de residência e domicílio.

Artigo 16.º

1 - Os Estados Partes tomam todas as medidas necessárias para eliminar a discriminação contra as mulheres em todas as questões relativas ao casamento e às relações familiares e, em particular, asseguram, com base na igualdade dos homens e das mulheres:

a) O mesmo direito de contrair casamento;

b) O mesmo direito de escolher livremente o cônjuge e de só contrair casamento de livre e plena vontade;

c) Os mesmos direitos e as mesmas responsabilidades na constância do casamento e aquando da sua dissolução;

d) Os mesmos direitos e as mesmas responsabilidades enquanto pais, seja qual for o estado civil, para as questões relativas aos seus filhos; em todos os casos, o interesse das crianças será a consideração primordial;

e) Os mesmos direitos de decidir livremente e com todo o conhecimento de causa do número e do espaçamento dos nascimentos e de ter acesso à informação, à educação e aos meios necessários para permitir o exercício destes direitos;

f) Os mesmos direitos e responsabilidades em matéria de tutela, curatela, guarda e adopção das crianças, ou instituições similares, quando estes institutos existam na legislação nacional; em todos os casos, o interesse das crianças será a consideração primordial;

g) Os mesmos direitos pessoais ao marido e à mulher, incluindo o que respeita à escolha do nome de família, de uma profissão e de uma ocupação;

h) Os mesmos direitos a cada um dos cônjuges em matéria de propriedade, aquisição, gestão, administração, gozo e disposição dos bens, tanto a título gratuito como a título oneroso.

2 - A promessa de casamento e o casamento de crianças não terão efeitos jurídicos e todas as medidas necessárias, incluindo disposições legislativas, serão tomadas com o fim de fixar uma idade mínima para o casamento e de tornar obrigatório o registo do casamento num registo oficial.

PARTE V

Artigo 17.º

1 - Com o fim de examinar os progressos realizados na aplicação da presente Convenção, é constituído um Comité para a Eliminação da Discriminação contra as Mulheres (em seguida denominado Comité), que se compõe, no momento da entrada em vigor da Convenção, de dezoito e, depois da sua ratificação ou da adesão do 35.º Estado Parte, de vinte e três peritos de uma alta autoridade moral e de grande competência no domínio abrangido pela presente Convenção. Os peritos são eleitos pelos Estados Partes de entre os seus nacionais e exercem as suas funções a título pessoal, devendo ter-se em conta o princípio de uma repartição geográfica equitativa e de representação das diferentes formas de civilização, assim como dos principais sistemas jurídicos.

2 - Os membros do Comité são eleitos por escrutínio secreto de entre uma lista de candidatos designados pelos Estados Partes. Cada Estado Parte pode designar um candidato escolhido de entre os seus nacionais.

3 - A primeira eleição tem lugar seis meses depois da data da entrada em vigor da presente Convenção. Pelo menos três meses antes da data de cada eleição, o Secretário-Geral da Organização das Nações Unidas dirige uma carta aos Estados Partes para os convidar a submeter as suas candidaturas num prazo de dois meses. O Secretário-Geral elabora uma lista alfabética de todos os candidatos, indicando por que Estado foram designados, lista que comunica aos Estados Partes.

4 - Os membros do Comité são eleitos no decurso de uma reunião dos Estados Partes convocada pelo Secretário-Geral para a sede da Organização das Nações Unidas. Nesta reunião, em que o quórum é constituído por dois terços dos Estados Partes, são eleitos membros do Comité os candidatos que tenham obtido o maior número de votos e a maioria absoluta dos votos dos representantes dos Estados Partes presentes e votantes.

5 - Os membros do Comité são eleitos para um período de quatro anos. No entanto, o mandato de nove dos membros eleitos na primeira eleição termina ao fim de dois anos; o presidente do Comité tira à sorte os nomes destes nove membros imediatamente depois da primeira eleição.

6 - A eleição dos cinco membros adicionais do Comité realiza-se nos termos das disposições dos parágrafos 2, 3 e 4 do presente artigo, a seguir à 35.ª ratificação ou adesão. O mandato de dois dos membros adicionais eleitos nesta ocasião termina ao fim de dois anos; o nome destes dois membros é tirado à sorte pelo presidente do Comité.

7 - Para suprir eventuais vagas, o Estado Parte cujo perito tenha cessado de exercer as suas funções de membro do Comité nomeia um outro perito de entre os seus nacionais, sob reserva da aprovação do Comité.

8 - Os membros do Comité recebem, com a aprovação da Assembleia Geral, emolumentos retirados dos fundos da Organização das Nações Unidas, nas condições fixadas pela Assembleia, tendo em conta a importância das funções do Comité.

9 - O Secretário-Geral da Organização das Nações Unidas põe à disposição do Comité o pessoal e os meios materiais que lhe são necessários para o desempenho eficaz das funções que lhe são confiadas pela presente Convenção.

Artigo 18.º

1 - Os Estados Partes comprometem-se a apresentar ao Secretário-Geral da Organização das Nações Unidas, para exame pelo Comité, um relatório sobre as medidas de ordem legislativa, judiciária, administrativa ou outra que tenham adoptado para dar aplicação às disposições da presente Convenção e sobre os progressos realizados a este respeito:

a) No ano seguinte à entrada em vigor da Convenção para o Estado interessado;

b) Em seguida, de quatro em quatro anos, e sempre que o Comité o pedir.

2 - Os relatórios podem indicar os factores e dificuldades que afectam a medida em que são cumpridas as obrigações previstas pela presente Convenção.

Artigo 19.º

1 - O Comité adopta o seu próprio regulamento interior.

2 - O Comité elege o seu secretariado para um período de dois anos.

Artigo 20.º

1 - O Comité reúne normalmente durante um período de duas semanas no máximo em cada ano para examinar os relatórios apresentados nos termos do artigo 18.º da presente Convenção.

2 - As sessões do Comité têm lugar normalmente na sede da Organização das Nações Unidas ou em qualquer outro lugar adequado determinado pelo Comité.

Artigo 21.º

1 - O Comité presta contas todos os anos à Assembleia Geral da Organização das Nações Unidas, por intermédio do Conselho Económico e Social, das suas actividades e pode formular sugestões e recomendações gerais fundadas no exame dos relatórios e das informações recebidas dos Estados Partes. Estas sugestões e recomendações são incluídas no relatório do Comité, acompanhadas, sendo caso disso, das observações dos Estados Partes.

2 - O Secretário-Geral transmite os relatórios do Comité à Comissão do Estatuto das Mulheres para informação.

Artigo 22.º

As instituições especializadas têm o direito de estar representadas aquando do exame da aplicação de qualquer disposição da presente Convenção que entre no âmbito das suas actividades. O Comité pode convidar as instituições especializadas a submeter relatórios sobre a aplicação da Convenção nos domínios que entram no âmbito das suas actividades.

PARTE VI

Artigo 23.º

Nenhuma das disposições da presente Convenção põe em causa as disposições mais propícias à realização da igualdade entre os homens e as mulheres que possam conter-se:

a) Na legislação de um Estado Parte;

b) Em qualquer outra convenção, tratado ou acordo internacional em vigor nesse Estado.

Artigo 24.º

Os Estados Partes comprometem-se a adoptar todas as medidas necessárias ao nível nacional para assegurar o pleno exercício dos direitos reconhecidos pela presente Convenção.

Artigo 25.º

1 - A presente Convenção está aberta à assinatura de todos os Estados.

2 - O Secretário-Geral da Organização das Nações Unidas é designado como depositário da presente Convenção.

3 - A presente Convenção está sujeita a ratificação e os instrumentos de ratificação são depositados junto do Secretário-Geral da Organização das Nações Unidas.

4 - A presente Convenção está aberta à adesão de todos os Estados. A adesão efectua-se pelo depósito de um instrumento de adesão junto do Secretário-Geral da Organização das Nações Unidas.

Artigo 26.º

1 - Qualquer Estado Parte pode pedir em qualquer momento a revisão da presente Convenção, dirigindo uma comunicação escrita para este efeito ao Secretário-Geral da Organização das Nações Unidas.

2 - A Assembleia Geral da Organização das Nações Unidas decide das medidas a tomar, sendo caso disso, em relação a um pedido desta natureza.

Artigo 27.º

1 - A presente Convenção entra em vigor no 30.º dia a seguir à data do depósito junto do Secretário-Geral da Organização das Nações Unidas do 20.º instrumento de ratificação ou de adesão.

2 - Para cada um dos Estados que ratifiquem a presente Convenção ou a ela adiram depois do depósito do 20.º instrumento de ratificação ou de adesão, a mesma Convenção entra em vigor no 30.º dia a seguir à data do depósito por esse Estado do seu instrumento de ratificação ou de adesão.

Artigo 28.º

1 - O Secretário-Geral da Organização das Nações Unidas recebe e comunica a todos os Estados o texto das reservas que forem feitas no momento da ratificação ou da adesão.

2 - Não é autorizada nenhuma reserva incompatível com o objecto e o fim da presente Convenção.

3 - As reservas podem ser retiradas em qualquer momento por via de notificação dirigida ao Secretário-Geral da Organização das Nações Unidas, o qual informa todos os Estados Partes na Convenção. A notificação tem efeitos na data da recepção.

Artigo 29.º

1 - Qualquer diferendo entre dois ou mais Estados Partes relativamente à interpretação ou à aplicação da presente Convenção que não seja resolvido por via de negociação é submetido a arbitragem, a pedido de um de entre eles. Se nos seis meses a seguir à data do pedido de arbitragem as Partes não chegarem a acordo sobre a organização da arbitragem, qualquer delas pode submeter o diferendo ao Tribunal Internacional de Justiça, mediante um requerimento nos termos do Estatuto do Tribunal.

2 - Qualquer Estado Parte pode, no momento em que assinar a presente Convenção, a ratificar ou a ela aderir, declarar que não se considera vinculado pelas disposições do parágrafo 1 do presente artigo. Os outros Estados Partes não estão vinculados pelas mesmas disposições nas suas relações com um Estado Parte que tiver formulado uma tal reserva.

3 - Qualquer Estado Parte que tenha formulado uma reserva conformemente às disposições do parágrafo 2 do presente artigo pode em qualquer momento retirar essa reserva por uma notificação dirigida ao Secretário-Geral da Organização das Nações Unidas.

Artigo 30.º

A presente Convenção, cujos textos em inglês, árabe, chinês, espanhol, francês e russo fazem igualmente fé, é depositada junto do Secretário-Geral da Organização das Nações Unidas.
